Use this guide to connect insurance principles with everyday life-agent decisions in Vietnam. Each concept explains a distinction, works through an original example and identifies a specific error to avoid. Monetary examples are hypothetical and use Vietnamese dong (VND). References identify the insurance-certificate framework; the teaching explains durable foundations rather than particular statutory provisions.

Insurance and Life-Protection Foundations

1. Risk pooling and expected claims

Pooling spreads covered financial losses across many insured lives. Expected claims equal the number of comparable exposures multiplied by the assumed event probability and benefit. This estimates a group average, not an individual's outcome. Expenses, uncertainty and other pricing considerations mean expected claims alone do not determine premiums.

Worked example: A hypothetical pool has 1,000 lives, a 0.2% annual death probability and VND 100 million per covered death. Expected annual claims are VND 200 million.

Mistake to avoid: Treating the expected claim cost as the insurer's complete premium calculation.

2. Pure risk and investment risk

Pure risk involves loss or no loss; speculative risk includes a possible gain. Life insurance addresses financial consequences of specified events, while an investment component can expose value to market movements. Evaluate protection and investment promises separately, even when a product combines them.

Worked example: A policy provides a contractual death benefit and a fund account. A fund decline changes the investment value; its effect on death benefits depends on the policy formula.

Mistake to avoid: Assuming an insurance label guarantees every investment outcome.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

3. Insurability and correlated exposures

Insurers need sufficiently assessable events and losses to price and manage cover. Pooling becomes less predictable when many members share an exposure that can cause simultaneous claims. A larger pool therefore does not automatically remove concentration risk; the relationships between exposures also matter.

Worked example: Insuring 2,000 workers at one industrial site creates more shared-event exposure than insuring comparable workers across unrelated locations. The insurer should assess that concentration separately.

Mistake to avoid: Judging pool quality solely by the number of insured people.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

4. Physical, moral and behavioral hazards

A hazard increases the likelihood or severity of loss. Physical hazards concern conditions such as dangerous work; moral hazard involves dishonesty; behavioral hazards concern carelessness. These categories help distinguish risk assessment from verification and prevention. A higher-risk condition does not itself establish dishonest behavior.

Worked example: Working at height is a physical hazard. Deliberately hiding that occupation is a moral hazard. Ignoring required workplace precautions illustrates a behavioral hazard.

Mistake to avoid: Calling every risky occupation evidence of fraud.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

5. Material facts and disclosure

A material fact can influence an insurer's assessment, acceptance or terms. Application questions should receive accurate answers, with uncertain information clarified rather than guessed. The consequences of incomplete disclosure depend on applicable law and the contract; an agent should neither promise forgiveness nor declare automatic claim rejection.

Worked example: An applicant cannot remember the date of a hospital admission. The agent records the uncertainty and obtains clarification instead of entering an invented date.

Mistake to avoid: Leaving out information because the agent personally considers it harmless.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

6. Good faith in both directions

Good faith supports an honest exchange of relevant information. Applicants should give accurate risk information, while agents should explain benefits, limitations and obligations faithfully. A truthful sentence can still mislead if surrounding information hides a decisive condition. Specific legal consequences require the applicable Vietnam rules and policy terms.

Worked example: An agent describes an accident rider's additional payment and also explains its accident definition and exclusions. The customer receives the conditions behind the advertised benefit.

Mistake to avoid: Presenting a benefit accurately while concealing conditions that determine eligibility.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

7. Insurable interest and legitimate protection

Insurable interest concerns a legitimate connection to the insured life, rather than a wager on another person's death. Financial dependence, family support and business obligations help explain a protection purpose. Qualifying relationships, required consent and the relevant timing must be checked under applicable rules.

Worked example: A business seeks cover connected to a partner's documented financial contribution. That explains a potential protection need, but the insurer must confirm the permissible arrangement.

Mistake to avoid: Assuming any person may insure any other person merely by paying premiums.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

8. Fixed benefits and indemnity

Fixed-benefit insurance pays an agreed amount when the contractual event occurs. Indemnity insurance reimburses an eligible financial loss within its terms. Life death benefits generally follow the fixed-benefit approach, while expense reimbursement follows a different calculation. Identify the benefit structure before deciding whether actual expenditure limits payment.

Worked example: A qualifying fixed death benefit of VND 600 million is not reduced merely because funeral expenses were VND 40 million.

Mistake to avoid: Using funeral expenditure to calculate a contractual fixed death benefit.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

9. Causation and the covered event

Causation asks which event or chain of events is relevant to coverage. For accident benefits, the policy's definitions and exclusions determine what causal connection matters. Proximate cause generally concerns the effective cause, not simply the event closest in time. Agents should gather facts without deciding disputed medical causation.

Worked example: A claimant reports a fall followed by hospitalization and death. The agent forwards the event history and evidence for assessment rather than assuming the final diagnosis determines accident coverage.

Mistake to avoid: Choosing the latest event as the decisive cause without checking the contract.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

10. Subrogation and contribution

Subrogation concerns an insurer's recovery rights against a responsible third party after an indemnity payment. Contribution concerns sharing an indemnity loss between overlapping insurers. Neither mechanism should be applied automatically to fixed life benefits. Each valid life policy may create a separate payment obligation under its own terms.

Worked example: Two policies provide fixed death benefits of VND 300 million and VND 500 million. Both qualifying benefits total VND 800 million, without proportionally dividing funeral costs.

Mistake to avoid: Importing property-insurance contribution calculations into fixed life benefits.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

Life Products and Policy Rights

11. Term insurance and coverage duration

Term insurance covers a specified period under the contract. Coverage duration is distinct from the premium-payment schedule. Renewal, conversion and survival payments exist only where the product provides them. Assess whether the protection period matches the customer's need and what happens when that period ends.

Worked example: A hypothetical policy expires after 15 years without renewal. A death in year 16 falls outside that expired cover, even if every required premium was paid.

Mistake to avoid: Assuming completed premiums extend protection beyond the stated term.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

12. Whole-life protection and cash value

Whole-life insurance is designed for long-duration life protection and commonly includes contractual cash values. The death benefit and cash value serve different functions. They are not automatically paid together. Distinguish guaranteed values, any non-guaranteed additions and conditions that maintain cover using the particular policy.

Worked example: A policy specifies a VND 700 million death benefit and a VND 90 million surrender value. Those figures alone do not establish a VND 790 million death payment.

Mistake to avoid: Adding cash value to the death benefit without a supporting policy provision.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

13. Endowment and maturity benefits

An endowment combines protection during a defined period with a benefit on survival to maturity. Death and maturity benefits may differ. The end of premium payments is a separate milestone from maturity, so a customer must understand when each obligation ends and when each benefit becomes payable.

Worked example: A hypothetical endowment requires premiums for 10 years and matures after 20 years. Finishing premiums in year 10 does not trigger its year-20 maturity payment.

Mistake to avoid: Confusing the premium-payment term with the maturity date.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

14. Annuities and longevity risk

An annuity provides payments according to a specified structure. Lifetime payments address the risk of outliving resources; fixed-period payments end after their stated duration. Survivor benefits, guaranteed periods and capital refunds depend on the contract. Comparing nominal payments alone does not account for timing or survival conditions.

Worked example: VND 4 million monthly for 60 months totals VND 240 million in nominal payments. That schedule alone promises no payments after month 60.

Mistake to avoid: Describing a fixed-period income stream as guaranteed lifetime income.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

15. Riders and benefit interactions

A rider adds or modifies protection but has separate triggers, limits and duration. An additional benefit increases payment when its event qualifies; an accelerated benefit pays part of an existing benefit earlier. Check how a rider affects remaining cover, because similar benefit labels can conceal different payment structures.

Worked example: An illustrative accelerated rider pays VND 150 million from a VND 600 million benefit. If the terms reduce remaining cover by that amount, VND 450 million remains.

Mistake to avoid: Treating every rider payment as extra money above the original benefit.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

16. Owner, insured person and beneficiary

The policy owner holds contractual rights; the insured person is the life on which coverage depends; the beneficiary receives a designated benefit. These roles may belong to different people. Consent requirements, change authority and payment entitlement must be checked separately rather than inferred from family relationships.

Worked example: Lan owns a policy on Minh's life and names their daughter as beneficiary. The daughter's designation does not itself give her authority to surrender the policy.

Mistake to avoid: Assuming the beneficiary controls all policy decisions.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

17. Beneficiary instructions and allocations

Beneficiary instructions need clear identities and allocations consistent with the policy's permitted arrangements. Check that percentage shares form the intended total and that changes are properly processed. Payment where a beneficiary dies first, lacks capacity or cannot be located requires contractual and legal interpretation.

Worked example: A VND 800 million qualifying benefit allocated 65% to one beneficiary and 35% to another produces VND 520 million and VND 280 million respectively.

Mistake to avoid: Treating an informal family conversation as a completed beneficiary change.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

18. Assignment of policy rights

Assignment transfers specified contractual rights rather than simply naming a payment recipient. Its scope can be broad or limited, such as securing a debt. Read the assignment document alongside the policy and applicable rules to determine which rights move, what restrictions apply and how the insurer records the arrangement.

Worked example: A policy is assigned as security for a loan. The agent checks the documented security rights before processing a surrender request from the original owner.

Mistake to avoid: Assuming assignment and beneficiary nomination have identical effects.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

19. Premium due dates, grace periods and lapse

A due date, grace-period expiry and lapse date answer different questions. A grace period offers a contractual opportunity to pay an overdue premium; continuing cover and deductions depend on the terms. Use the insurer's confirmed policy status before describing protection after missed payments.

Worked example: A customer misses a due date, but the insurer confirms the policy remains within its contractual grace period. The agent explains the payment action and relevant coverage conditions.

Mistake to avoid: Declaring immediate lapse solely because the due date has passed.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

20. Reinstatement after lapse

Reinstatement restores a lapsed policy when the applicable conditions and acceptance requirements are met. Paying overdue amounts may be necessary without being sufficient. Health evidence, other outstanding obligations and the restoration date can matter. Keep a reinstatement request separate from confirmation that cover has resumed.

Worked example: An owner pays arrears while a requested health declaration remains outstanding. The agent records the payment but does not describe the policy as restored before confirmation.

Mistake to avoid: Promising automatic reinstatement when overdue premiums are received.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

21. Surrender and net proceeds

Surrender ends the policy in return for any amount payable under its provisions. Surrender value can differ substantially from premiums paid. Outstanding policy debt or other specified deductions may reduce proceeds. Evaluate both the money received and the protection lost before explaining the transaction.

Worked example: A hypothetical surrender quotation is VND 72 million, with VND 12 million of deductible policy debt and no other deductions. Net proceeds are VND 60 million.

Mistake to avoid: Presenting the quoted surrender value as the customer's final cash receipt.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

22. Paid-up options and reduced benefits

Where available, a paid-up option can stop further premiums while preserving reduced contractual protection. It differs from surrender, which ends the policy, and from maintaining the original benefit. Availability, benefit calculation and rider treatment require the insurer's policy-specific confirmation.

Worked example: An insurer offers an illustrative reduced paid-up benefit of VND 180 million instead of the original VND 400 million. The owner retains the reduced cover, with rider status checked separately.

Mistake to avoid: Explaining paid-up status as unchanged protection without further premiums.

Legal Framework and Agent Responsibilities

23. Law, policy terms and insurer procedures

Legal requirements, contractual promises and internal procedures have different sources. An insurer's checklist does not prove a statutory duty, and a brochure does not replace policy wording. For Vietnam questions, identify the applicable authoritative rule before applying a deadline, entitlement or prohibition.

Worked example: A servicing checklist asks for a particular form. The agent describes it as an insurer processing requirement unless an applicable legal provision also establishes that requirement.

Mistake to avoid: Calling every internal procedure a requirement of Vietnam law.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

24. Certification and activity authorization

Evidence of qualification is distinct from authorization to carry out a particular activity. A certificate alone does not demonstrate an insurer appointment, product authorization or permission to make binding decisions. Current Vietnam certificate categories and agent conditions require confirmation from the applicable official rules.

Worked example: A person presents an insurance-agent certificate. Before assigning sales activity, the insurer also verifies the relevant relationship and the scope of activities that person may perform.

Mistake to avoid: Treating a certificate as unrestricted authority for every insurance product and function.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

25. The insurer-agent agreement

An agency agreement defines the relationship between insurer and agent, including assigned activities and contractual responsibilities. Its existence does not eliminate legal duties or expand authority beyond applicable limits. Determine who must perform a task and whether delegation is permitted before acting.

Worked example: An agreement permits forwarding applications but does not authorize transferring customer files to another salesperson. The agent seeks an approved arrangement before sharing those files.

Mistake to avoid: Assuming all convenient sales activities are covered by a general agency relationship.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

26. Limits of delegated decision authority

Explaining products and receiving documents are different from accepting risk, waiving exclusions or approving claims. Any delegated decision authority must be explicit and exercised within its conditions. When authority is absent or unclear, refer the decision to the authorized insurer function.

Worked example: A customer asks an agent to remove an occupation exclusion. The agent submits the request for authorized review rather than promising that a handwritten alteration changes cover.

Mistake to avoid: Making a contractual promise merely because the customer expects an immediate answer.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

27. Insurer oversight and agent accountability

An agent's conduct and an insurer's supervision are separate dimensions of accountability. A review should examine both what happened in the customer interaction and whether institutional controls detected or permitted it. Exact liability and sanctions depend on applicable law, agreements and authorized findings.

Worked example: Repeated use of an inaccurate presentation calls for correction of affected explanations and review of the insurer's approval and supervision process.

Mistake to avoid: Assuming oversight eliminates the agent's responsibility for an inaccurate representation.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

28. Instructions, signatures and valid consent

A signed document records an action but does not automatically establish that the correct person had authority or understood the instruction. Check identity, capacity, relevant permissions and the permitted signing process. Questions about legal validity should go to an authorized reviewer rather than be resolved through assumptions.

Worked example: A relative signs an owner's alteration request without documented authority. The agent seeks the required clarification instead of processing it as the owner's instruction.

Mistake to avoid: Equating a family relationship with authority to sign contractual instructions.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

29. Authorized premium collection

Receiving premiums requires verified authority and the insurer's approved payment process. Separate receiving funds, issuing evidence of receipt and confirming coverage. A payment record proves a transaction; its effect on insurance depends on applicable terms and authorized acceptance.

Worked example: A customer offers payment to an agent's personal account. The agent directs payment through the insurer's authorized channel and explains how to obtain a verifiable receipt.

Mistake to avoid: Assuming any payment to someone describing themselves as an agent establishes coverage.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

30. Recognizing prohibited-conduct questions

Analyze conduct concretely: what was represented, concealed, altered or obtained, and who was affected. Deliberate falsification and misleading explanations warrant escalation, but exact Vietnam prohibitions and legal consequences require the applicable provision. Distinguish a factual concern from a completed legal finding.

Worked example: An agent changes an income figure after the applicant signs. The original and altered records are preserved and escalated; the agent does not invent a statutory penalty.

Mistake to avoid: Assigning a specific offence or sanction without confirming the governing rule.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

31. Amendments, effective dates and transition rules

A document's publication date can differ from the date its provisions take effect. Transitional clauses may preserve earlier arrangements or specify how pending matters are handled. The reference identifies an amendment to Vietnam's certificate rules, but its title alone cannot resolve an individual's qualification position.

Worked example: Two certificate instructions appear inconsistent. The reviewer compares their effective dates and applicable transitional provisions before deciding which governs the case.

Mistake to avoid: Applying the newest-looking document without checking commencement and transition conditions.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

32. Customer redress and conduct review

A customer's requested remedy and a review of agent conduct are separate matters. Correcting a record, reconsidering a claim or addressing a complaint does not automatically determine disciplinary consequences. Use the appropriate authorized channels and confirm applicable Vietnam complaint rights without promising a particular result.

Worked example: A customer reports an inaccurate sales explanation and requests correction. The insurer reviews the requested remedy while separately assessing the agent's conduct.

Mistake to avoid: Promising that an internal complaint automatically creates a refund or establishes misconduct.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

Customer Needs and Professional Conduct

33. Fact finding before recommending a product

A useful fact find records dependants, income, obligations, existing protection, objectives and constraints. Separate confirmed facts from estimates. The recommendation should follow the identified need rather than letting a favored product determine which questions are asked or which information is ignored.

Worked example: A parent seeks education protection. The agent establishes the children's ages, funding needs, existing resources and support period before comparing policies.

Mistake to avoid: Starting with a product illustration and collecting only facts that support selling it.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

34. A transparent capital-needs calculation

A simplified capital estimate adds debts, planned expenses and family support, then subtracts resources genuinely available for those purposes. Avoid counting the same resource twice. State assumptions: a nominal estimate does not incorporate inflation, investment returns or discounting unless those are explicitly modeled.

Worked example: Debts of VND 500 million, education of VND 200 million and support of VND 480 million total VND 1,180 million. Subtracting VND 180 million in available savings and VND 300 million in existing cover leaves VND 700 million.

Mistake to avoid: Deducting essential housing as immediately available cash without testing that assumption.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

35. Matching duration to the protection need

Different obligations end at different times. Map expected dependency, debt repayment and continuing support needs before choosing coverage duration. A single benefit period may leave an uncovered later need or provide an unsuitable structure. Revisit assumptions when circumstances change.

Worked example: A loan is expected to end in eight years, while dependent support is needed for 14 years. Eight-year protection alone leaves six years of the support objective unaddressed.

Mistake to avoid: Using the shortest obligation to set the duration of every protection need.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

36. Affordability and sustainable premiums

Affordability concerns continuing payment capacity, including essential spending, variable income and emergency needs. The ability to pay the initial premium is insufficient evidence. Compare the actual commitment with the household's cash flow and discuss how income changes could affect maintaining cover.

Worked example: Monthly income is VND 28 million, essential spending VND 23 million and planned reserves VND 2 million. VND 3 million remains before any insurance premium and other discretionary commitments.

Mistake to avoid: Using the entire remainder as a universal safe premium allowance.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

37. Suitability through comparable benefits

Suitability connects the customer's need with benefit amount, duration, conditions, affordability and relevant guarantees. Compare like features before drawing a conclusion from price. A cheaper policy may meet the need, but lower cost alone does not establish a better recommendation.

Worked example: Two quotations have equal death benefits, but one ends before the child's dependency period finishes. The agent identifies that duration gap before recommending either policy.

Mistake to avoid: Ranking products solely by premium while ignoring unequal protection.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

38. Guaranteed and projected values

A guarantee is a contractual promise subject to its conditions. A projection illustrates an outcome using assumptions that may not occur. Clearly separate guaranteed benefits from projected bonuses or investment values, and explain the customer's position if projected results are lower.

Worked example: An illustration shows a guaranteed maturity benefit of VND 250 million and a projected total of VND 340 million. The VND 90 million difference is not a contractual guarantee.

Mistake to avoid: Calling a projected total the amount the customer will definitely receive.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

39. Replacement and continuity of protection

Replacement can create surrender losses, fresh underwriting, different exclusions and a coverage gap. Compare the existing contract with the replacement terms actually accepted by the insurer. A preliminary quotation is insufficient for deciding whether cancellation preserves the customer's protection objective.

Worked example: A proposed replacement excludes a condition covered under the existing policy. The agent explains that lost protection before the customer decides whether to replace.

Mistake to avoid: Cancelling existing cover on the strength of an unaccepted application.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

40. Conflicts of interest and inducements

A conflict arises when commission, targets or personal relationships can distort a recommendation. Identify the influence, explain relevant conflicts and preserve a recommendation based on documented needs. Disclosure does not cure unsuitable advice, and any proposed inducement must be checked against applicable rules.

Worked example: A higher-commission policy requires an unaffordable payment commitment. The agent recommends the affordable suitable alternative and records the customer-based reason.

Mistake to avoid: Treating disclosure of commission as permission to recommend an unsuitable product.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

41. Confidentiality and proportionate information use

Collect customer information for a defined purpose and share it only through authorized channels with appropriate recipients. Sensitive health and financial details require particular care. Consent to one use does not justify unrelated sharing. Check current applicable Vietnam requirements and insurer controls for collection, access and disclosure.

Worked example: An agent forwards requested medical documents securely to underwriting, without copying a sales discussion group that has no underwriting role.

Mistake to avoid: Assuming information collected during a sale is available for unrestricted team use.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

42. Understanding, vulnerability and informed decisions

Distress, limited financial understanding, disability or pressure can make a decision more difficult. Adapt explanations and allow appropriate support without assuming incapacity. Ask the customer to explain relevant conditions in their own words; a signature alone does not demonstrate understanding.

Worked example: A bereaved customer mistakes surrender value for the death benefit. The agent clarifies both amounts and pauses the decision until the distinction is understood.

Mistake to avoid: Using urgency or emotional distress to obtain a quick signature.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

Applications, Underwriting and Claims

43. Adverse selection and information imbalance

Adverse selection occurs when people with higher expected insured loss are more likely to seek cover, particularly where they know more about their risk than the insurer. Underwriting addresses this information imbalance. Higher risk and deliberate fraud are different: an applicant can disclose an elevated risk honestly.

Worked example: A person expecting a major health assessment applies for increased cover and accurately answers all questions. The risk may need review without establishing dishonesty.

Mistake to avoid: Treating every higher-risk application as an attempted fraud.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

44. Applications as traceable evidence

An application records information used in assessment and issue. Answers must reflect the applicant's actual information, with uncertainties clarified and corrections traceable. Help explain a question without supplying a convenient answer. The applicant should review the completed record before confirming it through the permitted process.

Worked example: An occupation was entered incorrectly. The agent follows the correction process, preserves the change history and obtains the required confirmation of the corrected description.

Mistake to avoid: Erasing an inaccurate answer in a way that hides who changed it.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

45. Medical underwriting and role boundaries

Medical underwriting assesses information relevant to insured risk; it is separate from diagnosis and treatment. Agents collect requested evidence securely and refer assessment to authorized professionals. Standard terms, modified terms, postponement or decline are possible decisions, but the agent should not predict acceptance from a single health fact.

Worked example: An applicant discloses ongoing medical follow-up. The agent forwards the requested evidence and awaits assessment instead of declaring the condition automatically acceptable or uninsurable.

Mistake to avoid: Offering medical interpretations to secure an underwriting outcome.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

46. Financial underwriting and justified cover

Financial underwriting examines the rationale for the requested amount, using relevant income, obligations, existing cover and business interests. A needs estimate and underwriting evidence serve different purposes. A plausible need does not guarantee acceptance, and an unexplained large amount should prompt clarification rather than invented income figures.

Worked example: A business requests key-person cover. It supplies records explaining the insured person's contribution and replacement costs so the insurer can assess the proposed amount.

Mistake to avoid: Assuming the customer's requested sum alone establishes financial justification.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

47. Premium factors and payment frequency

Premiums reflect benefit design, assessed risk, duration, expenses and pricing assumptions. Compare payment frequencies using actual scheduled amounts, since monthly premiums need not equal one-twelfth of the annual amount. Also check whether future premiums are fixed or can change under the contract.

Worked example: A quotation offers VND 12 million annually or VND 1.1 million monthly. Twelve monthly payments total VND 13.2 million, which is VND 1.2 million more.

Mistake to avoid: Assuming all payment frequencies have the same annual cost.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

48. Exclusions, definitions and benefit limits

An exclusion removes specified circumstances from coverage. A benefit limit caps payment for a covered circumstance. Definitions identify the event that qualifies in the first place. Read these provisions together with endorsements before interpreting an offer or explaining a claim result.

Worked example: A rider caps a qualifying payment at VND 100 million but excludes a specified activity. The cap does not make an event during that excluded activity eligible.

Mistake to avoid: Treating a payment limit as evidence that all events are covered.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

49. Waiting periods and benefit commencement

A waiting period delays eligibility for a specified benefit according to its wording. It differs from the policy commencement date and from a premium grace period. Check which benefit is affected, how the period is measured and whether reinstatement or changes alter the relevant timing.

Worked example: An illustrative rider excludes qualifying events during its first three months. An event in month two is within that waiting period, even though the base policy has commenced.

Mistake to avoid: Assuming every benefit becomes available on the base policy's start date.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

50. Claim evidence and claimant entitlement

Claim evidence must establish the insured event, relevant contractual conditions and the recipient's entitlement. Different documents answer different questions. Specify what is missing and why it matters, using the insurer's requirements without inventing documents, legal presumptions or guaranteed settlement outcomes.

Worked example: Evidence of death establishes the event, but the claimant's identity still needs verification. The agent requests the missing identity evidence rather than describing the whole claim as unproven.

Mistake to avoid: Assuming proof of the event also proves who must receive payment.

Certificate framework reference: Vietnam Ministry of Finance Circular 151/2025/TT-BTC, effective 2026 amendments to agent-certificate rules

51. Coverage assessment through an event timeline

A claim timeline connects commencement, premium status, alterations, the insured event and notification. These dates answer different questions. Assess contractual coverage at the relevant event date while checking separate notification conditions. A later report does not itself establish when the event happened or whether cover applied.

Worked example: An event occurred while the insurer confirms cover was active, but notification arrived later. Coverage timing and compliance with notification provisions require separate assessment.

Mistake to avoid: Substituting the notification date for the insured-event date.

52. Claims investigation and reasoned review

Investigation should test relevant discrepancies with focused evidence. Record the conflict, what could resolve it and how it relates to the contractual decision. A challenge may introduce new evidence or simply dispute interpretation; both should reach the appropriate review process without an agent promising approval.

Worked example: Two records give different event dates. The claims team seeks clarification before deciding which date governs coverage, and explains any outstanding evidence request.

Mistake to avoid: Treating a discrepancy as sufficient proof that a claim is fraudulent.

Customer Protection and Financial-Crime Controls

53. Customer identification and verification

Identification records who a customer claims to be; verification tests that identity using appropriate reliable evidence. Collecting a name alone does not complete verification. Follow current institutional requirements and resolve inconsistencies carefully, because a typographical error and an identity substitution require different responses.

Worked example: An application contains a different birth date from the identity document. The agent seeks clarification and follows the correction process before treating verification as complete.

Mistake to avoid: Checking that a document exists without comparing its details with the application.

54. Beneficial ownership and control

For an entity customer, beneficial ownership concerns the natural people who ultimately own or control it under applicable definitions. Intermediate companies and nominees can obscure that relationship. A policy beneficiary is a different role. Current Vietnam definitions, thresholds and evidence requirements must be confirmed through authorized compliance guidance.

Worked example: A company owns the proposed policy through another corporate entity. Compliance examines the ownership chain rather than recording only the immediate company's name.

Mistake to avoid: Using the named policy beneficiary as the answer to an entity-ownership question.

55. Third-party payments and funding explanations

A third-party payer may have a legitimate reason, but the relationship and transaction purpose need appropriate understanding. Source of funds concerns the origin of money used for the transaction; source of wealth concerns how broader assets accumulated. Follow applicable evidence requirements without assuming either legitimacy or wrongdoing.

Worked example: A sibling pays a premium using sale proceeds. The relationship explains who is paying; documentation of the proceeds addresses the transaction's funding source.

Mistake to avoid: Treating the payer's relationship as a complete explanation of where the money originated.

56. Risk-based customer due diligence

Customer due diligence assesses relevant customer and transaction risks using applicable institutional procedures. Complex ownership, unusual payment patterns or unexplained changes can require deeper review. A risk-based approach changes the extent of examination; it does not remove mandatory checks or allow an agent to create unsupported risk thresholds.

Worked example: A customer's routine payments suddenly involve several unrelated payers. The agent records the change and refers it for assessment of any additional checks.

Mistake to avoid: Skipping required identification because a customer previously appeared low risk.

57. Sanctions alerts and possible matches

A screening alert indicates a possible match, not a confirmed identity. Authorized reviewers compare relevant identifiers and apply the institution's current procedures and applicable restrictions. An agent should neither dismiss an alert based on familiarity nor independently decide its legal transaction consequences.

Worked example: A customer's name resembles a listed person's name, but their birth dates differ. The agent refers the identifying details for authorized resolution of the alert.

Mistake to avoid: Treating a shared name as conclusive proof of a sanctions match.

58. Suspicion escalation and restricted disclosure

Escalate concerns through designated channels using observable facts, dates and patterns. Suspicion does not require an agent to establish a crime, but a red flag is not proof. Avoid unauthorized discussion of possible reporting or internal review; confirm applicable Vietnam reporting and restricted-disclosure rules through compliance.

Worked example: A payer requests unexplained refunds to different accounts. The agent reports the pattern internally without announcing that a financial-crime report has been or will be filed.

Mistake to avoid: Warning the customer about confidential reporting activity or conducting an unauthorized investigation.

59. Fraud indicators and evidence preservation

Fraud involves deliberate deception; inconsistent records alone do not prove intent. Application and claim concerns can involve altered documents, false identities or conflicting event information. Preserve originals and record observations without rewriting evidence. Refer authenticity and intent questions to the authorized review function.

Worked example: A submitted income record shows unexplained alterations. The agent preserves the received file and records the discrepancy instead of replacing it with a cleaner version.

Mistake to avoid: Editing suspicious evidence before reviewers can examine the original.

60. Audit trails, retention and authorized cooperation

An audit trail connects instructions, identities, dates, approvals and payments so another reviewer can reconstruct events. Retention periods and disclosure conditions depend on current applicable requirements. Keep records accurate and route requests from authorities through authorized channels, preserving both legitimate cooperation and confidentiality.

Worked example: A reviewer asks who approved a beneficiary alteration. The file contains the owner's instruction, verification, processing date and approval record, allowing the sequence to be reconstructed.

Mistake to avoid: Deleting earlier records because only the latest policy status appears relevant.

Frequently Asked Questions

Practical answers to help you apply the guidance for Vietnam Basic Life Insurance Agent Certificate Examination.

Can two life policies both pay for the same death?
Each valid fixed-benefit policy may pay its own contractual death benefit when its conditions are satisfied. Do not automatically apply indemnity contribution rules. Check each policy's terms, status and claimant entitlement separately.
Does paying overdue premiums immediately restore cover?
That depends on policy status and terms. Payment during a grace period differs from reinstatement after lapse. Reinstatement may require evidence and insurer acceptance, so obtain confirmation of the effective coverage position.
Which Vietnam requirements need current official confirmation?
Confirm the exact certificate category and examination syllabus, agent conditions and authorization, applicable legal duties, complaint routes, financial-crime controls and record-retention requirements. Use policy documents for product-specific rights and benefit conditions.
How should an agent respond to a suspicious claim document?
Preserve the original, record the specific discrepancy and refer it through the authorized review process. An indicator justifies examination; it does not establish fraud or authorize the agent to reject the claim.
